Compensation for Lost Time
Salaried employees (faculty and staff) with a medically certified disability may be eligible to receive workers' compensation leave for up to 92 calendar days.Faculty and staff in the Virginia Sickness and Disability Program (VSDP) must serve a seven calendar-day waiting period to receive VSDP/ workers’ compensation disability benefits and are not eligible for workers’ compensation leave during the waiting period. In order to continue receiving pay during the waiting period, the employee must use his/her accrued leave for time away from work. Once the waiting period has passed, the employee will use short-term disability leave if the claim is covered.
Faculty and staff in the traditional sick leave program may use workers’ compensation leave during the waiting period only if authorized by the Workers’ Compensation Office. In some cases authorization is given pending approval of the claim. If the Division of Risk Management (DRM) later denies the claim, the employee’s leave and pay records must be amended using accrued leave or leave without pay.
If authorization is not initially given to use workers’ compensation leave during the waiting period and the employee remains disabled from work, the supervisor should contact the Workers' Compensation Office for instructions on how to continue processing the employee’s leave.
Hourly employees are not eligible for workers’ compensation leave. They also are subject to a seven-day waiting period before becoming eligible for lost time benefits paid by DRM.
